These Terms of Service (“Terms”) govern your access to and use of Will You Be Attending, including our websites, applications, self-serve demo, event tools, messaging features, and related services (the “Service”). The Service is operated by Kurtz & Boon LLC.
By creating an account, using the Service, running a demo, or clicking to accept these Terms, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service does
Will You Be Attending helps hosts create events, manage guest lists, send invitations and updates, track RSVPs, organize replies, and use automation to answer routine questions or flag messages for review. The Service may include email, SMS, in-app demo chat, file import, dashboards, analytics, and related tools.
2. Accounts
- You must provide accurate account information and keep it current.
- You are responsible for keeping login credentials secure and for activity under your account.
- You must notify us promptly if you suspect unauthorized access.
- We may suspend or terminate accounts that violate these Terms or create risk for the Service, other users, guests, or service providers.
3. Event hosts and guest communications
If you upload guest information or send messages through the Service, you are responsible for having the rights, permissions, consent, or other lawful basis necessary to contact those guests. You agree not to use the Service for spam, unlawful marketing, harassment, deceptive messages, or communications that violate applicable email, SMS, privacy, consumer protection, or anti-spam laws.
You are responsible for event content, guest lists, message templates, instructions, and any information you provide. We are not responsible for inaccurate event details entered by a host.
4. SMS and email delivery
Email and SMS delivery depends on third-party providers, carrier networks, recipient settings, spam filters, and other factors outside our control. We do not guarantee that any message will be delivered, opened, read, or responded to. Message and data rates may apply to SMS recipients.
5. Automation and AI-assisted features
The Service may use automation and AI-assisted tools to parse guest lists, classify replies, draft responses, answer routine questions, and flag messages. These features are provided to assist hosts, but they may be incomplete, delayed, inaccurate, or inappropriate for a particular situation. You are responsible for reviewing important information and decisions.
Do not rely on the Service for emergency communications, legal advice, medical advice, financial advice, or other high-stakes decisions.
6. Demo service
The self-serve demo is for evaluation and testing only. Demo messages may be simulated or handled separately from live event workflows. We may limit, throttle, delete, or disable demo sessions to prevent abuse, protect deliverability, or manage costs.
7. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, abusive, or harassing activity.
- Upload or transmit malware, exploit code, or content that interferes with the Service.
- Attempt to access accounts, data, systems, or APIs without authorization.
- Reverse engineer, scrape, overload, or disrupt the Service except as allowed by law.
- Send unsolicited bulk messages, cold outreach, or marketing messages without proper consent.
- Use the Service to collect or process sensitive information unless you have appropriate authority and safeguards.
- Misrepresent who you are, who an event is from, or why a recipient is being contacted.
8. Usage fees, messaging balance, and payment
Core event management is free. Current prices for prepaid messaging balance, seating, postcards, and future paid products are shown on the website or during checkout and may change over time. If you enable automatic replenishment or submit a message send with an insufficient balance, you authorize us and our payment processor to charge your saved payment method for the selected pack or required deficit, subject to any minimum charge disclosed before use. You can disable automatic replenishment in billing settings.
Messaging credit purchases are final and non-refundable. Messaging credits do not expire and remain in your account until used for any current or future event. Fulfilled postcards and activated seating access are non-refundable unless otherwise stated at checkout or required by law. You are responsible for applicable taxes, carrier charges, or third-party fees associated with your use of the Service.
9. Third-party services
The Service may depend on third-party providers for hosting, analytics, payment processing, AI-assisted processing, email delivery, SMS delivery, and other functions. Your use of third-party services may also be subject to their terms and policies.
10. Intellectual property
We and our licensors own the Service, including software, design, branding, logos, content, and related intellectual property. You may not copy, modify, distribute, sell, or create derivative works from the Service except as allowed by these Terms or with our written permission.
You retain rights to content you submit, such as event details, guest lists, uploaded files, and messages. You grant us a limited license to host, process, transmit, display, and use that content as needed to provide, secure, support, and improve the Service.
11. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Service, you agree that we may process information as described there.
12. Beta features and availability
Some features may be experimental, incomplete, or in beta. We may change, suspend, or discontinue any feature at any time. We aim to keep the Service reliable, but we do not guarantee uninterrupted availability.
13. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.
14. Limitation of liability
To the fullest extent permitted by law, Kurtz & Boon LLC and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, delivery failures, event disruptions, or substitute services.
To the fullest extent permitted by law, our total liability for claims related to the Service will not exceed the greater of the amount you paid us for the Service in the three months before the claim or $100.
15. Indemnification
You agree to defend, indemnify, and hold harmless Kurtz & Boon LLC from claims, damages, liabilities, losses, and expenses arising from your use of the Service, your event content or guest data, your violation of these Terms, or your violation of applicable law or third-party rights.
16. Termination
You may stop using the Service at any time. We may suspend or terminate access if we believe you violated these Terms, created risk, failed to pay fees, or used the Service in a way that could harm guests, users, providers, or our systems. Certain sections of these Terms will survive termination, including payment obligations, intellectual property, disclaimers, limitation of liability, and indemnification.
17. Changes to these Terms
We may update these Terms from time to time. If changes are material, we may provide notice through the website, account dashboard, or email. Continued use of the Service after changes become effective means you accept the updated Terms.
